Oh boy, that's a good question. When you apply for permanent residency, you should also apply for adjustment of status and a work permit, which should be enough evidence to obtain the DL. If it was me, I'd wait it out. Good luck!

I've been here on a TN-1 since May of 2000, so it's definitely do-able. I would think the TN-1 would be easier than the H1-B at the moment since there would be no burden to prove there were no US citizens qualified for your position.
